FCC Part 15 Subpart C

Conditional

Any product with a radio remote (key fob, RF receiver) sold in the US.

An intentional radiator requires lab testing, certification through an FCC-recognised body, and an FCC ID on the label. Wired or infrared-only controls fall under the lighter Supplier Declaration route instead.

FMVSS 118 (power windows and panels)

Not applicable

Power windows, partitions and roof panels on new vehicles.

A power tailgate is none of those three, so FMVSS 118 does not reach it. Aftermarket accessories are generally outside FMVSS, which binds new vehicles and OE replacement equipment.

Indirect FMVSS exposure

Conditional

Any accessory whose installation could put the vehicle out of compliance.

Blocking a required lamp or the licence plate is the realistic risk, not the accessory itself.
